Nope, learned from your comment. The TOI report has a bit more details: http://timesofindia.indiatimes.com/India/Bloggers-can-be-nailed-for-slur/articleshow/4178823.cms
Will have to wait for details to emerge.
This is hardly the first time a political party has filed a case against a blogger or orkut user. Congress sued the hinduunity.org site. I believe a few lawsuits were filed by BSP as well.
The response of the Supreme Court with due respect, is disappointing. While some limits to free speech is understandable, the other side must have an opportunity to get frivolous lawsuits squashed without much effort. Without such a recourse essentially the internet community will get muzzled in no time. Also, India lacks guidelines and infrastructure to deal with internet related disputes.
But then again, we don't know what the issue was at the moment. Hopefully more details will emerge soon.
if a blogger gets it based on a shiv sena complaint, it might get even more difficult for those who criticize other 'popular' political groups. Your other image (fish tank on a flush) appears more appropriate to this situation. Is anyone paying any attention?
Normally they go after the really edgy stuff and only after blogs that have a certain amount of traffic.
In case of Congress and BSP, the legal actions were somewhat justified. The NDTV vs. Kunte was another category altogether.
We just don't know enough about this particular case.
Hopefully these cases will help define the contours of online freedom of speech over time, absent an initiative from the Government. Ideally this initiative should come from a non-Government body. But it is not an ideal world.
Bloggers should at least be permitted the same freedom as newspapers. If a newspaper can make a corruption charge, bloggers should be able to. Needless to say so far within the Indian blogosphere we haven't really seen a blogger initiated action. Bloggers quote and rant about news items.
Keep in mind the political parties are a bit paranoid now because of the election season. Once the elections are over, things will calm down a bit.
